Background

The purpose is to hold the Supreme Court accountable for their failure to protect the constitutional rights of all Americans and in Noem V Perdomo allowing the use of racial profiling against Americans of color, in particular Latinos, thus depriving them of due process and equal protection under the law. We are specifically target Brett Kavanaugh because he wrote the opinion that rationalizes the use of racial profiling by immigration authorities.
This effort will pressure members of Congress to begin the process to impeach Justice Kavanaugh.

Proposal

We call on The Congress of the United States of America to pass articles of impeachment against Associate US Supreme Court Justice Brett Kavanaugh for failing to uphold his oath of office which requires that he affirm and support the constitution.

In particular by ruling, In Noem V Perdomo on September 8 2025, that:

“… although “apparent ethnicity alone cannot furnish reasonable suspicion” for an immigration stop, reasonable suspicion can rest on the “totality of the circumstances.” Here, he stressed, circumstances such as the “extremely high number and percentage of illegal immigrants in the Los Angeles area,” the fact that undocumented immigrants often “gather in certain locations to seek daily work” and “often work in certain kinds of jobs, such as day labor, landscaping, agriculture, and construction,” and “that many of those illegally in the Los Angeles area come from Mexico or Central America and do not speak much English” can, when “taken together,” “constitute at least reasonable suspicion of illegal presence in the United States.”

 
This ruling, to stay a lower court’s order which had halted the use of racial profiling by immigration agents, opened the door to an apartheid state with varying classes of citizens with varying degrees of protection from governmental abuse. Justice Kavanaugh has deprived untold numbers of American Citizens and lawful residents of their rights to due process and equal protection under the law. This is a clear and heinous violation of the 14th amendment of the constitution. Millions of American Citizens and legal residents of various ethnicities are now singled out and must carry the burden of proving their citizenship, a burden not shared by white Americans. This is a violation of the constitution’s 14th amendment by depriving non-white citizens of the same protections under the law as white Americans. And as we have seen this injury to the rights of one group becomes an erosion of the rights of all Americans who do not adhere to the views of the governing cabal.

No funds will be taken from the GP US treasury. All the costs of this proposal will be paid for by direct fundraising for this proposal.

 

Resources

Upon passage of this proposal the National Committee will seek volunteers to work with the Latinx Caucus and the other co-sponsors to act as a
“Brett Kavanaugh impeachment committee”, to plan and execute the petition drive to pressure Congress to initiate hearings on the impeachment of Brett Kavanaugh.
This committee will meet , via zoom, within one week of the passage of this proposal and will conduct regular planning meetings as it deems necessary.
This committee will work with the Fundraising committee to offset any costs generated by the printing of petitions and informational materials, or setting up an online petition, and presenting the petitions to various members of congress.
Estimated cost is between $1000 to $5000.
