Background

Prop 462 established the process for amending our Platform in 2010 and charged the Platform Committee with the following:

E) The Platform Committee shall identify potentially conflicting proposed platform amendments, work with sponsors to resolve them before they enter the voting period, and when any such conflict remains, submit a report to the National Committee once the proposed amendments have entered the discussion phase, identifying the conflict in specificity; and optionally, make recommendations on how to resolve the conflict.

 To implement the task of resolving conflicting amendments, the Platform Committee approved a procedure which states in part:

1. Should any two or more amendments found by the Platform Committee to create a policy conflict in the Platform achieve a 2/3 vote of the National Committee, a conflict resolution ballot shall be put to the National Committee to address and resolve the conflict.

2. The conflict ballot will be designed to best reflect the nature of the Platform conflict, whether in oppositional terms, ranked multiple options to resolve the conflict, or some other method which best reflects the nature of the conflict. The Platform Committee shall assist sponsors in reaching a compromise substitute where at all possible. Should the conflict ballot have more than two possible choices, the vote on the conflict ballot shall be conducted under the rules for single transferrable voting as provided by Article VII of these Rules and Procedures relating to elections. Should the approved conflict ballot offer only two choices, whether oppositional, yes / no, or some other two options, the choice receiving a simple majority will be accepted as resolution to the conflict.

Prop 468 from the California Green Party was approved by the National Committee and contained the following language amending our platform:

15. End the over-use of high-stakes standardized testing. Amend the "No

Child Left Behind" Act to eliminate state-wide norm-referenced standardized testing in favor of criterion-referenced testing.

However, the National Committee also approved two amendments from the Georgia Green Party, Prop 480 and 481, which dealt with privatization and militarization of our educational system that depended on the original language of the 2004 Platform calling for a repeal of NCLB remaining intact. That original language of the 2004 Platform reads:

w. The Leave No Child Behind Act must be repealed, especially the section

that gives the military access to student records.

This created a conflict. In spite of repeated calls for input, neither state participated in the Platform Committee's attempt to reconcile these differences. As a result, the Platform Committee Chapter 2 coordinators proposed maintaining the stronger language of repeal of NCLB in Prop 482.

The co-chair of the California Green Party, Sanda Everette, objected to this change in the discussion of Prop 582. As a result, the Platform Committee, in accordance with a procedure it adopted in August for reconciling conflicting amendments, agreed to remove the language of D.1.n. and bring it back as a separate proposal to allow the National Committee to decide which option it prefers.

The text in D.1.n. of Prop 582 was omitted and D.1.n. was intended as a place holder due to these two conflicting issues in regard to the No Child Left Behind Act.

The Platform Committee submits the following options for inclusion in the 2010 Platform in Chapter 2, D. Education and the Arts, 1. Education, point n.:
