Background

This proposal will add a mechanism for holding state parties accountable for violations of their accreditation agreement with the National Committee of
the Green Party, other than disaffiliation. National committee member states are justified in the expectation that their peers would abide by the same
set of rules.
None the less, keeping active state parties affiliated is also valuable. By creating this process for Censure and Temporary Suspension, we leave open the
opportunity for continued dialogue and for continued participation as observers to NC committees by representatives of the Censured state party’s representatives.
 

Proposal

Addition of the following language to the Rules and Procedures of the Green Party of the United States,
Article I. Accreditation:
VI. Procedure for Censure and Temporary Suspension of a State Party or Caucus
 
1.This process is intended to be an effort to address a violation of GP US National Committee Accreditation requirements which could otherwise result in
disaffiliation.
 
1.a This process can be initiated by the Accreditation Committee if it is deemed preferable, by a majority vote of the Accreditation Committee, to disaffiliation
of a State Party or Caucus at the conclusion of the process laid out in Article I, section V, of the GP US National Committee Rules and Procedures (see
references #1).
 
1b. This process can also be initiated by the National Committee by a request of 5 delegates from 5 member states or caucuses. Such a proposal for Censure
and Temporary Suspension can only be put forward once a proposal for Disaffiliation has been placed on the queue by request of the Accreditation Committee.
Once initiated by request of 5 delegates from 5 member states or caucuses of the National Committee, the steering committee will schedule the proposal
to run concurrently with the triggering proposal for Disaffiliation put forward by the Accreditation Committee. If both proposals reach a two thirds majority
of the vote the State or Caucus will be Disaffiliated.
 
1.c. The Accreditation Committee may not initiate a proposal for Censure and Temporary Suspension upon the failure of a proposal for disaffiliation.
 
2. Censure and Temporary Suspension of a State Party or Caucus will remove that State Party or Caucus from the National Committee votes list and affairs
list, and it will no longer have a vote on the National Committee. Their delegates may remain as observers on either or both lists but will not be allowed
to post to either list.
 
2 a. In deference to the vote of the National Committee required to elect members of the Steering Committee, any members of the censured State Party or
Caucus may remain as a member with full rights and responsibilities of the Steering Committee. But they may not run for reelection until their state or
caucus is reinstated.
 
3. A State Party or Caucus that has been Censured and Suspended may have Its representatives remain on other national committees, as full members, as observers,
or they may be removed. Each GP US Committee may decide whether or not a censured State Party or Caucus’ representatives are removed from their committee.
The censured State party or Caucus shall not assign new members to national committees during the censure and suspension period.
 
4. Each Caucus will determine the status of their members from a censured and temporarily suspended State Party or Caucus.
 
5. Censure and Temporary Suspension of a State Party or Caucus will require a 2/3 vote of the National Committee.
 
6. The duration of the Censure shall be stated in each proposal and shall be for a minimum of 6 months and a maximum of two years.
 
7. In order to address and resolve the violation that initiated the Censure and Suspension in a fair and unbiased manner, an ad-hoc committee comprised
of one member of the Accreditation Committee, one member of the Dispute resolution Committee, and one member of the Steering Committee, will be empaneled
to develop and oversee an individualized restoration plan to be completed by the State Party or Caucus that has been censured and suspended during the
period of suspension. The members of this ad-hoc restoration committee shall not be selected from any states or caucuses who have been a party to the complaint
against the censured and suspended state party, or from the censured state party or caucus. Each of the three committees who make up the restoration committee
will select its representatives.
 
8. At any point after a minimum of 6 months under suspension, if the Ad-hoc Committee believes the restorative plan has been completed, it may submit a
proposal to the National Committee restoring the suspended State Party or Caucus to good standing. Good standing shall be granted by a majority vote of
the National Committee. If this vote fails the censure will continue for the initial duration of the censure and suspension, or for an additional six months,
to be determined by the ad-hoc restoration committee.
 
9. If, at the end of the censure period, the State Party or Caucus has not completed the restoration plan, the Ad-hoc Committee shall inform the Steering
Committee. The Steering Committee will then submit a proposal to the National Committee, to disaffiliate the suspended State Party or Caucus. Disaffiliation
will require a two thirds majority vote. If that vote fails the Censured state party or caucus will be reinstated.

            6. Appeals Process
            An application which is contested by an individual or group may require the gathering of extensive evidence by the committee.
            This might include an on-site visit by an authorized representative of the committee. A written report should be mailed or e-mailed to             the
NC and the matter should be discussed and decided and the next general meeting of the GREEN PARTY National Committee.             Should the accreditation
committee recommend against approving an application, the committee is obligated to report that negative             recommendation to the applicant party,
giving the applicant party adequate time to prepare an appeal to the NC.
 
            V. PROCEDURES FOR REVOCATION OF ACCREDITATION
 
            1. A duly executed disaffiliation application may be granted without discussion. The committee should try to determine the reason and             report
to the NC.
 
            2. A grievance lodged against an accredited state (party) by an individual or group should be investigated by the committee as in the             appeals
process above. A hearing should be held at the next general meeting. The NC should formulate rules for conducting such             hearings.
