Background

The GPUS by-laws do not clarify a situation when a resignation is submitted and rescinded in a short period thereafter. This proposal's intent is to be able to officially accept Darlene Elias’ rescinding of her resignation and while providing more clarity in the by-laws.

The by-laws remain the same in instances of vacancy other than clarifying that in the vacancy instance where "a member has submitted a written statement of resignation to the National Committees Votes List," that there is a 7 day (168 hours and 0 minutes) window for a written withdrawal of the resignation to be submitted to the National Committees Votes List.

Proposal

Whereas, by-law 6-3.1 currently states:

6-3.1 A vacancy shall exist when a seat was not filled in an election;
when a member has submitted a written statement of resignation to the
National Committees Votes List; is recalled, is no longer a Green Party
member or dies or becomes incapacitated to act.

Be it resolved to change by-law 6-3.1 to state:

6-3.1 A vacancy shall exist when a seat was not filled in an election;
when a member has submitted a written statement of resignation to the
National Committees Votes List and does not submit a written
rescinding of the resignation within 7 days (168 hours and 0 minutes) to
the National Committee Votes List; is recalled, is no longer a Green Party
member or dies or becomes incapacitated to act.
